In the state of California, all property and assets obtained during a marriage is considered community property, subject to 50-50 division. This means that all money earned by either spouse as well as any property purchased during the marriage is to be shared equally. Any assets that were owned prior to the marriage, that were received as gifts or obtained as part of an inheritance are considered separate property and will not be divided.
Should you and your spouse be unable to agree upon the terms of your property division, your case will go to court and a judge will rule on the final outcome. The judge will rule based on what he or she considers to be a “just and right” manner, which may mean that one spouse receives more community property and/or liabilities than the other spouse. It would be in your best interest to keep a financial log prior to filing for divorce in order to have proper financial information regarding your and your spouse’s assets.
