When there is conviction of domestic violence, one spouse striking the other spouse and causing injury. There is a presumption in the family code that provides that the spouse that did the abusing usually will not get the children. Primary custody of those children goes to the abused spouse. That is a presumption in law that can be rebutted if there are certain facts; however, once there is domestic violence, the courts are very stringent in regarding who get custody of the children.
