California is a community property state which means that all the wealth acquired during the time of the marriage is community property and subject to division at the time of divorce. To opt out of this community property laws you have to have a prenuptial agreement, now this is one thing to consider if one party has accumulated an enormous amount of wealth or there is a marriage later in life. The prenuptial agreement initially states that all of the money that you take into the marriage remains separate property.
